Stacy Shea Luna (Shea)
Shea Luna is an attorney in the firm’s Lexington, Kentucky office where she is a member of the Health Care Service Group. She devotes her practice to health care law, focusing on regulatory and compliance, clinical operations, insurance, and data privacy and security. Shea’s health care law experience also includes contracting, employment, corporate transactions, licensure and certificate of need, fraud and abuse, medical staff and peer review, reimbursement, and other general regulatory matters. Shea also has provided general legal representation to public schools and universities, including advising and representing boards, committees, and leadership in the administration of these institutions covering areas such as open records, open meetings, student and faculty affairs, purchasing, student privacy rights, health care, governance, education, and other regulatory matters. Shea is Certified in Healthcare Privacy and Security with the American Health Information Management Association.

Prior to joining the firm, Shea was Associate General Counsel for Health Affairs at the University of Kentucky representing and advising the University of Kentucky in the administration of its UK HealthCare operations and academic medical center as well as other university matters. Additionally, Shea worked for the Kentucky Cabinet for Health and Family Services representing the Departments of Public Health and Medicaid in a wide array of matters including administrative rate appeals and was Assistant Counsel at Chenoweth Law Office representing local school districts in areas of labor and employment, contracting, education, and privacy. Shea began her legal career as Assistant Counsel for the United States Department of Energy, Oak Ridge Operations Office, Oak Ridge, Tennessee. Shea enjoys spending time with her husband and two daughters. Shea is an active member of her church and enjoys traveling, running, and hiking.

Providers and Laboratories Beware of EKRA: A Not-So-New Tool for Health Care Fraud and Abuse Enforcement
In an effort to combat the ongoing opioid crisis, Congress passed in 2018 the Eliminating Kickbacks in Recovery Act (“EKRA”) imposing significant monetary penalties on anyone paying or receiving payment for referrals to a recovery home, clinical treatment facility, or laboratory. However, given its broad language, EKRA may reach organizations not involved with substance abuse treatment. Health care providers and laboratories, therefore, should be aware of EKRA and its implications on their practice. Health Care Providers and Business Associates Beware: Use of Online Tracking Technology May Violate HIPAA
Entities regulated by the Health Insurance Portability and Accountability Act (HIPAA) may be surprised to learn that use of certain online tracking technology may result in inadvertently sharing information protected under HIPAA with unauthorized third parties. On December 1, 2022, the Office for Civil Rights (OCR) at the U.S. Department of Health and Human Services issued guidance with far-reaching implications for HIPAA regulated entities highlighting their HIPAA compliance obligations when using third-party online tracking technologies designed to collect and analyze information pertaining to a user’s interaction with the regulated entity’s webpages and mobile apps.
